The Rim Village Vista Home Owners Association, hereinafter referred to as HOA, adopts the following policy regarding the use, care, maintenance, and replacement of roofing and interior damage from roof failure (leakage, e.g.) attributable to second floor decks and patios of all units within the purview of the HOA.
Background: The HOA conducts periodic visual inspections and preventative maintenance of all flat roofs in order to minimize leaks which can cause interior damage to units. Over the past years, there has been an increase in leaks originating from these areas which cost the HOA money to repair not only the roof but any interior damage. Due to an increase in leaks and resulting costs as well as meeting with Roofing contractors that have told us these patio areas should have minimal use to preserve roof integrity, the Board has decided to enact a patio policy. Therefore, the placement of any foreign objects on the roof not only impedes the inspection process but also may result in roof deterioration
Deck Policy: The HOA will no longer accept responsibility for the repair, maintenance, upkeep, or replacement of the entire roof areas used as a deck or patio that have furniture, tables, chairs, lounges, etc. or coverings such as, but not limited to, carpets, coverings, pads or built-up decks placed over the roofing on the deck or patio area.
Furthermore, the HOA will no longer be responsible for the structural or interior damage caused by water leakage because of such unauthorized use in the above-described manor.
Normal foot traffic in such areas is permitted
Units affected: All HOA units that have access to an upper-level patio or deck. At the time of the policy, these are interior units on Buildings 1 through 11. This policy will apply to any potential future units of Rim Village Vistas that have a upper level patio/deck
Enforcement: When such unauthorized use is noted or observed, a written notification of violation of this policy will be furnished to the owner of the unit. The notice will advise the owner to cease and desist within 10 days of this notice.
The owner is responsible for the communication of this policy to their respective property managers, guests, or other occupants of their unit. Compliance rests solely with the unit owner.
Failure to comply with the written notification will result in a second written notification and subsequent filing of a notice stating HOA non-responsibility for the maintenance and replacement of the flat roof and responsibility for interior damage resulting from leaks.
This non-responsibility statement will be recorded with the Grand County Recorders Office. Such filed action will serve as notice and transfer of responsibility for compliance with this policy (use, care, maintenance and replacement of roof and any resultant interior damage) on future owners of the unit.
